Since the objectives of this Directive, namely to improve the ability of their members to exercise control over the activities of collective management organisations, to guarantee sufficient transparency by collective management organisations and to improve the multi-territorial licensing of authors’ rights in musical works for online use, cannot be sufficiently achieved by Member States but can rather, by reason of their scale and effects, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 ...[+++]of the Treaty on European Union.

2. By way of derogation from Article 3(1)(c), Member States may provide that signs or indications which may serve, in trade, to designate the geographical origin of the goods or services may constitute collective, guarantee or certification marks.

In order to guarantee a continuous, timely and efficient provision of the balance-of-payments statistics it is also desirable to ensure that readily available payments data, such as IBAN, BIC and the amount of the transaction or basic, aggregated payments data for different payment instruments may be still collected, if the collection process does not disrupt the automated payments processing and could be fully automated.

Simultaneously, this requires new collective guarantees for employees and a new effort to anticipate and adjust in time to a changing global economic and trade environment.
